| BLEICH/ELDER V CHICAGO TITLE INSURANCE COMPANY TITLE INSURANCE PREMIUM CLASS ACTION LITIGATION |
This website provides information and documents concerning a class action lawsuit brought on behalf of persons and entites in Florida that paid money to Chicago Title Insurance Company in a mortgage refinancing transaction from May 25, 2002, through the present. The lawsuit is called Bleich/Elder v. Chicago Title Insurance Company, and is pending in the Circuit Court of Miami-Dade County, Florida. The case has been certified as a class action.

On March 7, 2012, the trial court granted summary judgment in favor of Chicago Title Insurance Company. This means that the trial court ruled in Chicago’s Title favor, and found that Plaintiffs and the Class are not entitled to any damages. A copy of the trial court’s Order Granting Summary Judgment is available below, along with the motions and memoranda that Wites & Kapetan filed that asked the trial court to grant summary judgment in favor of Plaintiffs and the Class.
On behalf of Plaintiffs and the Class, Wites & Kapetan will appeal the trial court’s decision to the Third District Court of Appeal. We will ask the Third District to reverse the trial court’s ruling, and to direct the trial court to enter summary judgment in favor of Plaintiffs and the Class. The appeal process may last for a year or more.
